Terms of Service / Terms and Conditions of Pavilion Cosmetic Medicine

Introduction

All information contained on this webpage, accessed via https://www.pavilioncosmetic.com.au/terms-and-conditions is correct at the time of writing. Pavilion Cosmetic Medicine (or “the clinic” or “PCM”) may publish variations to website information or pricing guides provided, which may change by the time of your appointment.

Treatments vary from individual to individual and our practitioners may not be able to always treat you for what you have enquired about or made a booking for. Before determining if you are suitable for a treatment/procedure in question – and prior to proceeding with treatments – our practitioner [Cosmetic Doctor or Dermal Clinicians or Dermal Therapist depending on the treatment in question] must take a history, examine you and have a discussion over a consultation, to assess suitability and whether they are comfortable treating the individual.

Booking fees

All patients of Pavilion Cosmetic Medicine will be charged a booking fee to secure their appointment (whether consultation or treatment). The dollar value of the booking fee may vary from treatment to treatment. These fees are non-refundable and non-negotiable.

Consultation fees

All consultations at Pavilion Cosmetic Medicine are subject to payment for a consultation at the time of booking, in order to secure an appointment. The consultation fee/dollar value for each individual appointment may vary depending on the consultation type and/or practitioner type. The consultation fee may be used toward treatment under the following circumstances: [a] if the treatment is undertaken by the consulting Pavilion Cosmetic practitioner in the one appointment on the same day (if the allocated appointment time allows); -OR- [b] if the treatment plan developed for the individual patient is accepted and a future treatment session is booked with the same consulting practitioner in line with the treatment plan outlined, then the related consultation fee paid may be used as a credit/part-payment toward treatment fee with the same practitioner (assuming the consulting practitioner performs the treatment in question).

Please note: all treatment plans are valid for six [6] months from the date of consultation, thereafter, the initial treatment plan and the consultation fee paid will be forfeited and a new consultation, revised treatment plan and subsequent consultation fee will be required at the point of booking.

Each one patient is entitled to redeem their consultation fee toward treatment with the consulting practitioner once only ie. subsequent consultations are chargeable for the additional consultation, and no credit is transferrable toward the price of treatment. These fees are non-refundable and non-negotiable.

Procedure fees

Procedure fees vary according to the individual characteristics of the patient, the practitioner performing the procedure, the products utilised, treatment modality utilised for the procedure etc. It is the patient’s responsibility to be aware of the cost. Price guides are published to our clinic’s website. The prices on our website may be changed without notice. You are not obliged to go ahead with the procedure on the day should your budget not allow or should you decide not to have a procedure performed on the day. When consenting to the procedure, you are also consenting to paying for the procedure at the time of the procedure.

Some procedures require a consultation prior to booking a procedure. To obtain a quotation prior to your procedure, you may book a consultation with the treating practitioner – after which, you shall receive a quotation (quote) for treatment if requested. All treatment plans and quotes are valid for six [6] months from the consultation date. Pavilion Cosmetic Medicine reserves the right to re-consult with the patient if six [6] months have elapsed since the consultation date, and procedure fees are subject to change over time. If a written quote has been provided by Pavilion Cosmetic Medicine, the treatment plan and associated pricing will remain valid and will be honoured if within the six [6] month treatment plan validity timeframe.

Cancellation policy and cancellation fees

All procedures, treatments and consultations will require a booking fee payment at the point of making an appointment. Should you cancel your appointment with less than 48 hours’ notice prior to your scheduled appointment, a cancellation fee will apply. Cancellation fees vary from $50 to $500, depending on the appointment type and practitioner scheduled for the given appointment. Bookings will remain secured until a written or verbal cancellation is communicated with respect to 48 hours’ notice. Please note that a failure to respond to a communication from Pavilion Cosmetic Medicine is not considered as an acceptable form of appointment cancellation.

With respect to occurrences of ‘no show’ appointments, where a scheduled appointment is not attended by the patient and where the patient has not provided an acceptable cancellation notice prior to the appointment; Pavilion Cosmetic Medicine reserves the right to deny future service and/or deny a subsequent request to schedule future appointments in cases where patients do not present for their appointment(s) on two or more occasions.

Refund policy

As there is no guarantee with medical procedures, it is essential that the patient understands procedures are not an exact science. Every human body is different and may react differently. Whatever the outcome, the product and or service has been provided, and it is therefore not possible for Pavilion Cosmetic Medicine or the consulting practitioner to refund procedure fees. This is non-negotiable. Pavilion Cosmetic Medicine will make reasonable effort to achieve the aesthetic outcome the patient requests, however no guarantees are offered in relation to the effects of any procedure performed.

Refunds of booking fees are permitted only for appointments that are cancelled more than 48 hours prior to the scheduled appointment.

Credit card levy

Payments made by credit card will incur the current credit card surcharge at time of payment.

Medications/change in medical history

It is the patient’s responsibility to inform Pavilion Cosmetic Medicine when there is a change in their medical history (eg. pregnancy, cold sores etc) and medication (eg. Roaccutane etc). Should you arrive on the day of your appointment and the practitioner is unable to perform the procedure due to your medical condition or medications, a consultation fee of $150 for medical appointments and $50 for dermal appointments will be apply and be payable by the patient. In the unlikely event of an unforeseen emergency involving the care of the patient, the patient will be evacuated to a hospital at the discretion of attending paramedics. All costs relating to the transfer and care of the patient remain the responsibility of the patient. Please advise your treating practitioner of any procedures, medication either oral or topical that you are currently or have recently taken or used.

Review of procedure

Clinical post procedural reviews may be scheduled at defined intervals or when clinically indicated by Pavilion Cosmetic Medicine, depending on your treatment type. Reviews may be scheduled at defined intervals eg. two weeks, four weeks, eight weeks or twelve weeks etc, after the procedure has been performed by Pavilion Cosmetic Medicine (which is variable depending on the procedure type and individual circumstances of the patient). In cases of emergencies eg. vascular occlusion or infection, these will be treated as an emergency on a case-by-case basis, depending on the circumstances. Asymmetry, typical post treatment swelling, lumpiness etc will not be reviewed for at least two to four weeks unless advised otherwise by the treating Cosmetic Doctor from Pavilion Cosmetic Medicine. Unless there are signs of infection or other serious complications, no reviews will take place before the advised review time frame. It is the patient’s responsibility to inform the clinic if there are any signs of serious complications. Please call us Pavilion Cosmetic Medicine on 02 9439 9293 with any clinical concerns.

Hyaluronidase/Hyalase dissolving of dermal fillers

Should the patient request to dissolve any dermal fillers performed at Pavilion Cosmetic Medicine, a minimum of two to four weeks after the dermal filler procedure is required before assessment, noting that circumstances may vary. Depending on the circumstances, which may require a medical assessment, fees may apply to dissolve dermal fillers. The cost to the patient for dissolving the dermal filler may vary depending on the face/body area and circumstances involved (this will require an assessment by the treating Cosmetic Doctor).

Should the patient request to dissolve any dermal fillers performed elsewhere ie. outside of Pavilion Cosmetic Medicine, then a medical history may be requested from the treating practitioner and a medical assessment will be required prior to proceeding with treatment and fees will apply.

You may require up to three or more sessions to dissolve the dermal filler. Our Cosmetic Doctors reserve the right to decline the treatment of Hyalase if they feel it is unsafe or not in the patient’s best interest or if they wish to cease the practitioner patient relationship. In this case, Pavilion Cosmetic Medicine will refer the patient to another clinic for further treatment.

Photography

Every patient will have clinical photography prior to their initial consultation and/or treatment session, this is considered a standard part of a patient’s medical record. By making an appointment with Pavilion Cosmetic Medicine, patients are consenting to clinical photography as a standard practice. Photographs will be required to be taken again when advised by the practitioner.

Assessment of patient suitability

In accordance with AHPRA’s guidelines for non surgical cosmetic procedures, our practitioners will take steps to ensure the care and wellbeing of our patients. As part of AHPRA’s Guidelines, either in our consultation or treatment, our registered medical practitioners will make an assessment on the patient’s overall suitability for the cosmetic procedure. Under AHPRA’s guidelines (effective from 1 July 2023), Pavilion Cosmetic Medicine’s medical practitioners reserve the right to refer patients for a third party evaluation (eg. psychologist, psychiatrist or general practitioner); referred to persons who work independently of the practitioners treating at Pavilion Cosmetic Medicine. Despite the assessment and/or referral(s), Pavilion Cosmetic Medicine’s medical practitioners reserve the right to decline to perform cosmetic procedures if they believe that it is not in the best interests of the patient.

Ceasing the clinic/patient relationship

Pavilion Cosmetic Medicine’s staff, its doctors and other practitioners reserve the right to cease the clinic/patient relationship at any time. In this case, the patient may be referred to alternative doctors/therapists/clinic to continue their treatments.

With respect to occurrences of ‘no show’ appointments, where a scheduled appointment is not attended by the patient and where the patient has not provided an acceptable cancellation notice prior to the appointment; Pavilion Cosmetic Medicine reserves the right to deny future service and/or deny a subsequent request to schedule future appointments in cases where patients do not present for their appointment(s) on two or more occasions.

Asymmetry

All humans are asymmetrical. Our practitioners will take reasonable steps to improve on this if identified as a concern. All corrections of asymmetry post treatment are at the cost to the patient. Pavilion Cosmetic Medicine does not offer any complimentary treatments in the occurrence of asymmetry.

Communications with the clinic

All written correspondence to our clinic and the practitioners should be via our email accounts@pavilioncosmetic.com.au. Messages sent via Instagram (@pavilioncosmetic etc), Facebook or other, are not monitored or answered. Please do not send queries to these accounts, as they will not be answered.

Roles within the clinic

All clinical-related matters are managed by the Clinical Manager, under the guidance of the Cosmetic Doctors and other practitioners at Pavilion Cosmetic Medicine. Patient-related matters are managed by the Practice Manager.

Racism, hate speech, threats and cyberbullying

Racism, hate speech, threats and cyberbullying will not be tolerated by our clinic. Pavilion Cosmetic Medicine staff reserve the right to cease the clinic/patient relationship immediately should a patient or a proxy of a patient not adhere to this policy.

Feedback/complaints

Please email all feedback and complaints to accounts@pavilioncosmetic.com.au – and if applicable – steps will be taken under Complaints Management Protocol.

We do welcome feedback and/or complaints and for these to be directed to us at Pavilion Cosmetic Medicine as a first port of call (via email contact accounts@pavilioncosmetic.com.au). Working through concerns together will help to achieve continual improvement in the services we offer, which we are firmly committed to.

Patients do also have the right to make a complaint to Australian Health Practitioner Regulation Agency (AHPRA), the Health Care Complaints Commission (HCCC), or the Medical Council of New South Wales.

Virtual consultations

All images, audio and video created during virtual consultations with our team are the property of, and copyright to Pavilion Cosmetic Medicine. They are not to be recorded, shared or published without prior written permission from Pavilion Cosmetic Medicine.

There are no refunds under any circumstances from virtual consultations.

Changes

Pavilion Cosmetic Medicine has the discretion to update its Terms and Conditions and Privacy Policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal, or regulatory reasons.

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.
You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

Regarding Free Shipping: online products that are paid for at checkout and meeting a total price of $100.00 or more are entitled to free shipping on that order. Orders meeting this criteria are also entitled to a one [1] complimentary/free Healite session in-clinic at Pavilion Cosmetic Medicine (located in Crows Nest, NSW Australia); the Healite session must be redeemed within a three [3] month time frame from the date of purchase and the appointment must be scheduled via a team member working at Pavilion Cosmetic Medicine during opening hours. Appointments will be scheduled or rescheduled (which ever applies) to fall outside of NSW Government mandated times of closure such as COVID-19 lockdowns.

SECTION 2 – GENERAL CONDITIONS
We reserve the right to refuse service to anyone for any reason at any time.
